Terms of Use

1. Acceptance of Terms

By accessing or using FindMyUmrah ("Platform", "we", "us", "our") at findmyumrah.com and its subdomains, you ("User") agree to be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, you must stop using the Platform immediately.

These Terms apply to all users of the Platform, including pilgrims (visitors who search for agents), agents (travel agencies who list on the Platform), and any other visitor. Use of the Platform by agents also constitutes agreement to abide by any additional guidelines communicated during the registration process.

2. Nature of the Platform — Directory Service Only

FindMyUmrah provides a searchable directory of independently operating Hajj and Umrah travel agencies across India. Our role is limited to:

• Listing agent contact information and basic profile details.
• Displaying verified Google ratings and review counts sourced from publicly available Google data.
• Facilitating initial contact between pilgrims and agents via a WhatsApp link.

Any service, package, booking, or transaction that results from contact made through FindMyUmrah is an independent arrangement between the pilgrim and the agent. FindMyUmrah is not a party to that arrangement and has no involvement in it.

3. Agent Responsibilities & Listing Accuracy

Agents who register on FindMyUmrah agree to the following:

• Accurate information: You are solely responsible for ensuring that all information on your listing — including your agency name, contact number, email address, city, package types, and description — is accurate, current, and not misleading.
• Authorised representative: The person completing the registration must be authorised to act on behalf of the travel agency.
• Legitimate business: You represent that your agency is a legitimately operating travel business that is permitted to offer Hajj and/or Umrah services under applicable Indian law, including any relevant Ministry of Hajj or IATA requirements.
• Prompt updates: You agree to promptly update your listing if your contact details, package offerings, or operational status change. Outdated listings that mislead pilgrims may be removed.
• No false claims: You must not claim certifications, affiliations, ratings, or endorsements that you do not hold.
• Compliance with law: You agree to comply with all applicable Indian laws in conducting your travel business, including consumer protection regulations.

FindMyUmrah reserves the right to verify, edit, or remove any listing at any time if it is found to be inaccurate, misleading, or in violation of these Terms.

4. Pilgrim Use

Pilgrims using FindMyUmrah to search for agents agree to the following:

• The Platform is provided as an informational resource to help you identify and compare agents. It does not constitute a recommendation, endorsement, or guarantee of any listed agent.
• You are responsible for conducting your own due diligence before engaging any travel agent — including verifying licences, checking reviews, and comparing package terms directly with the agent.
• FindMyUmrah does not verify the identity or credentials of every pilgrim who contacts agents through our platform. Interactions with agents are at your own risk.

5. Free Listing Terms

FindMyUmrah offers a free basic listing for travel agencies. The free listing includes:

• Agency name, city, state, and contact information (phone/WhatsApp).
• Package type badges (Hajj, Umrah, or both).
• Display of your verified Google rating and review count (where available).
• A public profile page accessible via our directory search.

The free listing is provided at our discretion and may be modified or discontinued at any time. We reserve the right to remove any listing that violates these Terms, contains inaccurate information, or relates to a business that has ceased operations.

A free listing does not guarantee a specific position or ranking in search results. Placement in the free tier is determined by our search algorithm, which considers factors such as Google rating, review count, and city relevance.

6. Premium Features & Payments

FindMyUmrah offers optional premium and featured placement plans for agents who wish to increase their visibility on the Platform. These are subject to the following conditions:

• Fees: Premium plans are subject to the fees listed on our Pricing page. Prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• Billing: Payments are processed through our designated payment gateway. By purchasing a premium plan, you authorise us to charge the stated fee.
• Refund policy: Premium plan fees are non-refundable unless FindMyUmrah fails to deliver the agreed service. Disputes must be raised within 14 days of payment by emailing info@findmyumrah.com.
• No guarantee of results: Premium placement increases visibility but does not guarantee leads, enquiries, bookings, or revenue. We make no representations about the number of pilgrim contacts you will receive.
• Renewal: Premium plans do not auto-renew unless explicitly agreed at the time of purchase. You will receive a reminder before expiry.

7. Prohibited Uses

You must not use FindMyUmrah for any of the following purposes:

• Fraudulent listings: Registering fake agencies, using another agency's identity, or misrepresenting your credentials or affiliations.
• Spam and harassment: Sending unsolicited messages to pilgrims, other agents, or FindMyUmrah staff.
• Price gouging or deception: Advertising misleading prices or package inclusions that differ materially from what is actually offered.
• Scraping: Systematically extracting agent contact data, phone numbers, or any other data from the Platform using automated tools, bots, crawlers, or scrapers without our prior written consent.
• Interference: Attempting to disrupt, damage, or gain unauthorised access to our servers, databases, or systems.
• Illegal activity: Using the Platform to facilitate any activity that violates Indian law, including money laundering, fraud, or unlicensed travel services.
• Impersonation: Impersonating FindMyUmrah, any agent, or any other individual or entity.
• Harmful content: Uploading or transmitting content that is defamatory, obscene, discriminatory, or otherwise harmful.

Violation of these prohibitions may result in immediate removal of your listing, termination of your account, and referral to appropriate legal authorities.

8. Limitation of Liability

To the fullest extent permitted by applicable Indian law, FindMyUmrah and its owners, directors, employees, and affiliates shall not be liable for any loss, damage, or harm arising from:

• Your use of or inability to use the Platform.
• Inaccurate, incomplete, or outdated information in agent listings.
• Any transaction, service, package, or other arrangement between a pilgrim and an agent, including non-performance, sub-standard service, or fraud by an agent.
• Any loss of data, revenue, or profits arising from use of the Platform.
• Interruption, downtime, or errors in the Platform caused by technical failures, maintenance, or factors beyond our control.

FindMyUmrah's total liability in any circumstance shall not exceed the amount paid by the User to FindMyUmrah in the 12 months preceding the event giving rise to the claim, or INR 1,000 (whichever is lower) for users who have not paid anything.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy.

9. Pilgrim–Agent Disputes

FindMyUmrah is not involved in any transaction, service agreement, or relationship between pilgrims and agents. If a dispute arises between you and an agent regarding packages, payments, services, or any other matter, the dispute is solely between you and the agent.

FindMyUmrah:

• Does not mediate, arbitrate, or adjudicate disputes between pilgrims and agents.
• Does not hold funds on behalf of pilgrims or agents.
• Is not responsible for refunding payments made directly to agents.
• Will not be liable for any losses you suffer as a result of your dealings with an agent.

If you believe an agent on our Platform has engaged in fraud or significant misconduct, you may report it to us at info@findmyumrah.com. We will investigate and may remove listings that are found to be fraudulent or in clear violation of these Terms, but we are not obligated to resolve the underlying dispute or provide compensation.

10. Intellectual Property

All content on FindMyUmrah — including the website design, logo, brand name "FindMyUmrah", page layouts, icons, and original written content — is the intellectual property of FindMyUmrah and is protected by applicable Indian and international copyright law.

You may not reproduce, distribute, modify, or create derivative works from any FindMyUmrah content without our prior written permission.

Agent-submitted content (agency names, descriptions, photos) remains the property of the respective agent. By submitting content to FindMyUmrah, you grant us a non-exclusive, royalty-free, worldwide licence to display that content on the Platform and in promotional materials for the purpose of operating the directory.

Google ratings and review counts displayed on the Platform are sourced from Google and are subject to Google's terms of service.

11. Termination

FindMyUmrah reserves the right to suspend or permanently terminate any user account or listing, with or without notice, if we determine in our sole discretion that:

• These Terms have been violated.
• Listing information is materially inaccurate or misleading.
• The listed agency has ceased operations or is no longer offering Hajj/Umrah services.
• Continued operation of the account poses a risk to other users or to the reputation of the Platform.

Agents may request deletion of their listing and account at any time by emailing info@findmyumrah.com. Deletion will be processed within 30 days. Fees paid for premium plans are non-refundable upon voluntary termination.

12. Governing Law & Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms — including disputes relating to the validity, interpretation, performance, or termination of these Terms — shall be subject to the exclusive jurisdiction of the courts located in India.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

13. Changes to These Terms

FindMyUmrah reserves the right to update or modify these Terms at any time. When material changes are made, we will update the effective date at the top of this page. We may also notify registered agents by email.

Your continued use of the Platform after the updated effective date constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.
